Freedom of Information Act (FOIA)

PSC processes FOIA/Privacy Act requests; and FOIA Appeals to ensure compliance with federal laws, HHS FOIA regulations and policies. We respect the right of the public to access information in the possession of the Department, but also protect privileged information. We provide in-depth consultation services to HHS public health agencies and rapid responses to all requests for records in the custody and control of any components of the Program Support Center, the Office of the Assistant Secretary for Health, and the Agency for Healthcare Research and Quality.

Details

Services offered include:

  • Tracking requests and appeals from receipt to completion
  • Coordinating searches for responsive records
  • Advising officials who administer the FOIA
  • Negotiating with requesters on the scope and/or time needed to process requests
  • Reviewing documents for responsiveness and public disclosure
  • Interpreting FOIA laws and regulations; and the Department of Justice guidance on complex disclosure issues
  • Drafting response letters
  • Consulting with Operating Divisions and the Office of General Counsel regarding issues raised on appeal
  • Negotiating with appellants regarding issues raised on appeal
  • Drafting recommendations regarding issues raised on appeal and providing that recommendation to the Executive Officer, Deputy Agency
  • Chief FOIA Officer, and Assistant Secretary for Public Affairs
  • Coordinating with the Office of General Counsel regarding FOIA issues being litigated
